Article 1 – Definitions
The Supplier: Caché Studios, a sole proprietorship registered in the Netherlands under Chamber of Commerce (KvK) number 96347236 and VAT number NL005205015B21, established on Texel, the Netherlands.

The Terms and Conditions: This agreement.
The Order: An order placed by a person on the website.
The Products: The goods available for sale on the website.
The Customer: The person who places an order.
The Customer Service: Accessible via info.cachestudios@gmail.com.
Article 2 – General
These Terms and Conditions apply to all visitors and users of the website. By using this website and placing an order, you agree to be bound by these terms and conditions.
Should any provision of these Terms and Conditions be found to be invalid or unenforceable, the remaining provisions shall continue to apply in full.
The Terms and Conditions applicable to an order are those published at the time the order was placed. The customer is able to download and print these Terms and Conditions.
These Terms and Conditions are written in English. For any questions regarding the content, please contact our customer service.
Article 3 – Capacity and Acceptance
Anyone wishing to purchase products from Caché Studios must have the legal capacity to do so. Persons without legal capacity must purchase through their legal representatives, who will be bound by these Terms and Conditions.
The customer accepts these Terms and Conditions by checking the box stating "I agree with the Terms & Conditions" during the checkout process. No order can be finalised without this acceptance.
Caché Studios reserves the right to refuse any order in cases of suspected abuse, fraud, or bad faith.
Article 4 – Orders
When a customer places an order via the website, they make an offer to enter into a purchase agreement with Caché Studios.
Caché Studios makes every effort to keep stock information accurate and up to date. However, we reserve the right to cancel or partially fulfil an order if a product is out of stock or unavailable due to unforeseen circumstances. In such cases, the customer will be notified by email and offered the option to cancel the order or wait for restocking.
If the customer has already paid and the order is cancelled, a full refund will be issued within 14 days.
Caché Studios reserves the right to correct any pricing errors on the website. If a pricing error is discovered after an order has been placed, the customer will be informed and given the option to confirm the order at the correct price or cancel it for a full refund.
Article 5 – Prices
All prices on the website are displayed in euros (€) and include VAT unless stated otherwise.
Shipping costs are not included in the product price and will be displayed separately during checkout before the order is confirmed.
Caché Studios reserves the right to change prices at any time. However, the price applicable to an order is always the price at the time the order was placed, as confirmed in the order confirmation email.
Article 6 – Payment
Caché Studios accepts the following payment methods: iDEAL, Bancontact, PayPal, and Credit card (Visa & Mastercard).
Payments are processed securely via Shopify Payments. Caché Studios does not have access to or store any confidential payment details.
The customer's account will be charged upon confirmation of the order. Should a payment be refused by the customer's bank, the order will be automatically cancelled.
The customer warrants that they are authorised to use the chosen payment method and that sufficient funds are available.
Article 7 – Shipping & Delivery
Caché Studios ships throughout Europe using PostNL and DHL. Shipping costs and estimated delivery times are displayed during checkout and on our Shipping page.
Once an order has been dispatched, the customer will receive a confirmation email including a tracking code to follow the shipment.
Caché Studios is not responsible for delays caused by the carrier, customs, weather conditions, or other circumstances beyond our control.
The risk of loss or damage passes to the customer upon delivery.
For customers outside the European Union, customs duties and import taxes may apply. These costs are the sole responsibility of the customer. Caché Studios does not refund customs duties or international sales taxes.
Article 8 – Right of Withdrawal & Returns
In accordance with EU consumer law, the customer has the right to withdraw from their purchase within 14 calendar days of receiving the product, without giving any reason.
To exercise this right, the customer must notify Caché Studios within 14 days of receipt via info.cachestudios@gmail.com. Please include your order number, date of order, name and address, and the product(s) you wish to return. The product must then be returned within 14 days of notifying Caché Studios.
Items must be returned unworn and unwashed, in their original condition and packaging, with all original tags attached, and accompanied by the original order confirmation.
Return shipping costs are the responsibility of the customer. We strongly recommend using a tracked shipping service, as Caché Studios cannot be held responsible for returns lost in transit.
Once the returned item has been received and inspected, Caché Studios will process the refund within 14 days, using the same payment method as the original purchase.
The right of withdrawal does not apply to sale items, items that have been worn, washed, or damaged by the customer, or items returned without original tags or packaging.
Article 9 – Exchanges
If the customer wishes to exchange an item for a different size or colour, they must contact Caché Studios at info.cachestudios@gmail.com as soon as possible after receiving their order, and within 14 days of receipt.
The same conditions apply to exchanges as to returns. Additional shipping costs may apply.
Article 10 – Warranty
Caché Studios guarantees that all products are free from defects in materials and workmanship upon delivery, in accordance with Dutch and EU consumer law.
The customer is entitled to a 2-year statutory warranty from the date of delivery. If a defect becomes apparent within this period, the customer must notify Caché Studios within 2 months of discovering the defect.
This warranty does not cover normal wear and tear, damage caused by improper use, washing, or care, accidental damage, or items altered or repaired by the customer.
To file a warranty claim, please contact us at info.cachestudios@gmail.com with a description and photo of the defect, along with your order number.
Article 11 – Intellectual Property
All content on the Caché Studios website, including but not limited to logos, photographs, videos, text, and graphic design, is the exclusive property of Caché Studios or its partners and is protected by copyright and other intellectual property laws.
No content may be copied, reproduced, distributed, or used in any form without the prior written consent of Caché Studios.
Article 12 – Liability
Caché Studios cannot be held liable for indirect or consequential damages arising from the use of our website or products, errors in product descriptions or photography including minor colour variations, delays or failures in delivery caused by circumstances beyond our control (force majeure), or damage to the customer's devices resulting from use of the website.
In all cases where Caché Studios may be held liable, liability is limited to the amount actually paid by the customer for the order in question.
Article 13 – Privacy
Caché Studios processes personal data in accordance with the General Data Protection Regulation (GDPR). For full details on how we collect, use, and protect your personal data, please refer to our Privacy Policy.
Article 14 – Governing Law & Disputes
These Terms and Conditions are governed by Dutch law.
In the event of a dispute, the parties will first seek to resolve the matter amicably. If no resolution can be reached, the dispute will be submitted to the competent court of Rechtbank Noord-Holland (Alkmaar).
Consumers within the EU also have the right to submit disputes via the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Article 15 – Amendments
Caché Studios reserves the right to amend these Terms and Conditions at any time. Changes will be published on the website and will apply to all subsequent orders.
